being penalized for working? >> plus, when she got a $0.40 raise at work, this local mother figured it would help pay the bills. instead it nearly turned her family homeless. and pregnant firefighters forced to lose a paycheck. >> this is 9news now. >>. but first, we have late breaking news out of the district where an officer was injured in a bizarre accident. >> this happened less than an hour ago near randall circle in southeast dc, and that is where gary nurenberg joins us live. gary. >> reporter: hello, anita. we're at minnesote and southeast circle where the accident happened on the circle itself. let me step out of the frame for just a moment as police try to determine exactly what happened in this automobile accident. moments ago i was able to walk up just a bit closer. saw an suv with the flashers on on a curb. a victim of some kind of damage as well as a sedan it apparently has collided with. according to police, one of the officers was injured in some way by debris. we're not sure if you can see it. there is a large fence damaged.

apparently the cars after hit one another apparently got involved with the fence in some way. dc police officer has been taken to the hospital with non-life-threatening injuries. two other persons involved in some way with this automobile accident have also been taken to the hospital. again without life-threatening injuries. interestingly, police call this is a crime scene and say one of the people taken to the hospital is a suspect. i'm going to ask the fellow i'm working with paul lester to pan right just a little bit. you may be able to see a tow truck that has been brought in apparently to address the cars that are now blocking randall circle. we have put in a request as police themselves are trying to figure out what happened here just a few moments ago. and derek and anita, if they come to us with that information, which we anticipate, we'll get back to you as soon as we can. >> thank you for that. and now we go to more breaking news. and, folks, this one is a stunner. do you remember the former head of the imf charged with raping a new york hotel house keeper.

tonight that case is on the verge of collapse. so said law enforcement. the man was accused of attacking the housekeeper last month. the law enforcement forces say they keep finding holes in the house keeper's story. that she has outright lies. prosecutiontors reportedly met with the lawyers and talked about whether to dismiss the charges and at the very least it is looked like he may be released from house arrest as soon as tomorrow. >> wow. well, dc fire chief announced a major change todayp. >> this came after firefighters complained about taking unpaid maternity leave for months before giving birth. kristen fischer joins us live. kristen, the firefighters are arguing the changes aren't

enough. is that right? >> reporter: that's right. the whole controversy stems from the fact that the firefighters were given 30 days of light duty work before they were given sick leave. once they ran out, they had to go without pay before they were able to return to the job full-time. now under this new policy, they'll get 90 days of light duty work. >> i'm concerned that it's not quite enough. >> reporter: dc firefighter melissa davis is still eight weeks away from her due date but she's already been off the job for more than two months after her light duty assignment expired just 30 days in. >> since the union has brought it up and it's been a source of contention between labor and management. we decided to adjust the policy. >> reporter: dc fire chief kenneth ellerby announced the change wednesday which will triple the time they can be off. >> three months is great. it's better than 30 days. however, for a healthy pregnancy, i think a woman would

need five months. but she would be eligible to work a desk job. and then up to two months for recovery before she can go back to full duty. >> the president of the association agrees saying the change in policy will still force our pregnant female members to exhaust their sick leave and forego a paycheck in the interest of their unborn children. but the chief says the department needs to be fair to all firefighters, especially since there is a limited number of light duty jobs. >> any member who desires to be on limited duty beyond 90 days would have to submit a request and the request will be either granted or not granted based on a case by case basis. >> it means this new light duty policy applies to all firefighters, whether they're pregnant, sick or injured. but melissa and her union want the department to make a distinction. >> there is definitely a huge difference between an illness and an injury and a pregnancy.

>> now, the chief says if they do that, he's worried they'll be opening the door to discrimination lawsuits. but keep in mind the metropolitan police department already lets its employees do light duty work throughout their entire pregnancy. so that is the exact kind of policy that the firefighters union says they're going to continue to fight for. anita. >> okay. thank you. new at 11:00, some scary moments for more than a dozen people that got trapped inside the washington monument. firefighters had to help lower the elevator inside the historical tourist attraction after it became stuck just before 7:00 tonight. it was up about 490 feet when it stopped working. 16 people inside, thankfully no one was hurt. right now a 4-year-old boy is in the hospital after getting shot at an apartment complex playground in temple hills this afternoon. his shooter? >> a 5-year-old playmate. and tonight police are trying to figure out where the gun came from and where the adult supervision was and who should

be held responsible for this. now, before heading out to the breaking news, our gary nurenberg filed this report. >> reporter: ebony web calls the 4-year-old shooting victim her nephew. he was with friends when a 5-year-old neighbor shot him. >> i heard the noise and took him upstairs and cleaned him off and called the police and that was it. >> reporter: . the 5-year-old ran back to his nearby apartment where neighbors say he was being cared for by an 18-year-old sister while their mother was at work. that while ebony webb was cleaning the wound waiting for emts. >> yes. i was shaken. i was a little upset more so. but that's it. i'm still shaken. >> reporter: police are trying to determine where the gun came from and who owned it to see if maryland gun safety laws were violated. >> i mean, that's just upset. we have a lot of those. so there ain't too much i can say about that. they live and learn. they're going to learn from this lesson today.

yes, they are. >> once again, that was gary nurenberg reporting. the little boy is expected to recover. it is unlawful to store or leave a loaded firearm where a person knows or should know that an unsupervised person under the age of 16 could gain access to it. well, new tonight it looks like a place to overturn immigration to get in state tuition is moving forward. tonight opponents of the measure submitted the last significants they believe are need -- signatures they believe are needed to put the measure on the 2012 ballot. they handed the registers around 8:00 and they have more than 56,000 of the signatures and they -- and that's about what they need. the law was scheduled to take effect in less than an hour. a lawyer, a former administrative law judge and a prince george's county council member. tonight leslie johnson can add felon to that list. >> i made a mistake for which i today accepted responsible for my conduct. >> johnson pleaded guilty to

conspiracy to commit witness and evidence tampering. it was a scheme that unraveled only ten days after she was elected to office. today she admitted to flushing a $100,000 check down the toilet and trying to stash 80,000 in gash in her under garments as fbi agents were knocking on the house door. >> when you vote for a person to represent you, you don't vote for them with the thing in mind that they committed a crime or fraud. >> she needs to step down. >> prosecutors are recommending a prison term from 12-18 months. johnson says she intends to stay in office until she is forced to quit by being sent to prison. her formal sentencing october 13th. meantime husband jack johnson has pled guilty to more than $400,000 in cash and other favors in exchange for doing business with the county. he's due for sentencing september 15th. the guidelines called for up to

12 years behind bars. is naked ambition a good thing or a bad thing when looking for a job in this struggling economy? but when they wanted to hire exotic dancers, it placed an ad on the department of employment services. now, although the club apparently met all of the requirements for doing so, some department workers were offend and the department, therefore, asked the club to voluntarily withdraw the job listing, which it did earlier today. department spokesman declined an on camera clothed interview to talk about the policy. security at all airports is under the microscope after a man managed to get on a flight with somebody else's expired boarding pass and no government issued id. police say last week the man flew from new york to la. the plane was halfway there before the flight crew realized he was not supposed to be on board. they alerted authorities and they questioned him and let him

go. just yesterday he went back to lax, got back through security again with an expired ticket. but this time when he tried to board the plane the gate pulled him away and the police moved in and arrested him. >> we're supposed to have a multi-layered system of security. if one fails, the next lair will pick up the problem and it didn't here and that's very troubling. >> indeed. he is now charged with being a stow away and he has a court date on friday. tsa officials insist he never posed a threat. he did go through security checks for weapons and explosives. still ahead tonight, how a local mother and her severely disabled son almost ended up homeless because of a pay raise. also, off color and off the air. a pun that calls the president a [ bleep ] on live tv. that is coming up. and i'm meteorologist topper shutt. another great night is going to lead to another great wakeup weather forecast. here you go. in the morning 5:00, 60s.

a raise is always a good thing, right? well, before you answer, check out this story you'll only see it on 9. >> the story of a very small raise with huge consequences. it nearly put a struggling family in manassas out on the street. theresa hammond works at wal-mart and got a raise of $0.40 an hour. enough to help pay more of the bills for her and her two boys. the $0.40 was all it took for social security to cut her son's disability payments in half. hundreds of dollars a month gone. >> but who knows $0.40 would be such a big deal. >> theresa made sure she was paying the electric bill to keep her son alive, but she fell behind on the rent and was about to be evicted with her kids. fortunately the case manager for theresa's son stepped in with emergency cash and worked out an

agreement with the landlord. the family can stay put at least for now. a fast spreading virus has forced a fairfax county animal shelter to make a heart-breaking decision. they have to put down every single cat. about 80 of them. it took in some cats that had been infected with a respiratory virus that can be deadly. they tried to halt the tragedy and the vets decided to follow the national protocol. that means euthanize all of the cats. dogs are not affected. caught on tape, take your child to workday. the trouble is this guy's work is robbing a convenience store. he brought his 5-year-old boy with him when he knocked off a store. fortunately nobody got store. police later found dad and charged him with robbery and contributing to the delinquency of a minor. tonight the white house says an off color remark made about president obama was

inappropriate. this morning, mark hallburn called the president a four letter word starting with the letter d. it was on an appearance on more than joe discussing yesterday's conference. he quickly apologized on the air but msnbc has suspended him indefinitely. meantime, derek says we have far bigger problems. >> frankly, anita, we don't have time for that sort of nonsense. the country is rolling full tilt towards national default, as in bills not paid, checks not going out. not raising that debt ceiling by august will make the government shut down like a three-day weekend. yet a recent poll says 41% of us wants congress to happen with 38% saying otherwise. i have to figure a lot of people think raising the debt limit is giving a new credit card to a chronic shop holic. the problem is the debt limit is really a lot more like the coupon book to pay off the loan

quickly. all right. here is the deal. we are looking at a really another nice day on friday. it's almost hot but not humid. so that is good. it will be bearable. hot on saturday. humidity okay. it's getting up there a little bit but still okay. and we're looking at heat all the way through the holiday weekend into next week. and the only form of relief really will be isolated thunderstorms. there will be a couple on sunday. a couple more on the 4th. it shouldn't affect the fireworks. especially next tuesday. overnight clear skies and cool. open the windows again. turn off the ac. give it a rest because it's going to be cranking over the weekend. lows 58-68. and winds out of the northwest at ten. tomorrow morning mostly sunny and pleasant. 60s and 70s. if you get up early enough, it will be 60s. winds north, northwest at ten. and then by afternoon, mostly sunny. almost hot but not humid. high temperatures near 90. winds north, northwest at ten. air quality forecast to be code orange. it is a forecast. i don't think it's going to make unhealthy air tomorrow.

teams made money last year, which is why you have to figure that that lockout will get solved before the season begins. nobody wants to steal the golden goose. but the nba has no golden goose. three-quarters of their teams lost money last year. for them, a lockout is a good thing. they make more money not playing, which is why in just over 35 minutes the nba will begin a lockout. today's final meeting between the owners and players yielded no progress. the players want a hard salary cap. they want the owner getting the lion's share. the players say no way and that leaves us with no hoops. >> it worries me that we're not closer. and we spent all of this time trying to get closer. we have a huge philosophical divide. >> a lot of our fans and people follow our games still don't like the prospect of a lockout. we don't like it either. it's something that our owners feel like is the best way, i guess, to maybe get what they want. >> now, you may remember the last nba lockout was in 1998.
